1. Introduction

Welcome to PeakTrail Adventures. These Terms of Service ("Terms") govern your use of our mountain hiking services, website, and all related services provided by PeakTrail Adventures ("we", "us", or "our"). By accessing our website or booking any expedition, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services or website.

2. Acceptance of Terms

By registering for, accessing, or using our services, you confirm that you accept these Terms and agree to comply with them. These Terms apply to all visitors, users, and others who access or use our services.

If you are booking services on behalf of another person or organization, you represent and warrant that you have the authority to bind that person or organization to these Terms.

3. Booking and Reservations

All bookings are subject to availability and confirmation by PeakTrail Adventures. We reserve the right to refuse service to anyone for any reason at any time. When you make a reservation, you agree to provide accurate, current, and complete information about yourself as prompted by our booking forms.

A deposit or full payment may be required to secure your booking, depending on the specific expedition package. Payment terms will be clearly communicated at the time of booking. All prices are quoted in Australian Dollars (AUD) and are subject to change without prior notice.

Confirmation of your booking will be sent via email. Please ensure you provide a valid email address and check your spam folder if you do not receive confirmation within 24 hours.

4. Cancellation and Refund Policy

Cancellations must be made in writing via email to [email protected]. The following cancellation policy applies:

  • More than 30 days before expedition: Full refund minus 10% administration fee
  • 15-30 days before expedition: 50% refund of total booking cost
  • 7-14 days before expedition: 25% refund of total booking cost
  • Less than 7 days before expedition: No refund available

PeakTrail Adventures reserves the right to cancel or reschedule expeditions due to weather conditions, safety concerns, or insufficient participant numbers. In such cases, you will receive a full refund or the option to transfer to an alternative date.

5. Participant Requirements

All participants must meet minimum age and fitness requirements as specified for each expedition. You are responsible for ensuring you are in appropriate physical condition to participate safely in your chosen activity. We recommend consulting with a physician before undertaking any mountain hiking expedition.

Participants must disclose any medical conditions, injuries, or medications that may affect their ability to participate safely. Failure to disclose relevant medical information may result in removal from the expedition without refund.

All participants under 18 years of age must be accompanied by a parent or legal guardian who accepts full responsibility for their safety and conduct during the expedition.

6. Safety and Liability

Mountain hiking involves inherent risks including but not limited to: unpredictable weather, difficult terrain, wildlife encounters, altitude sickness, and potential for injury. While PeakTrail Adventures takes all reasonable precautions to ensure participant safety, we cannot eliminate all risks associated with outdoor adventure activities.

Participants must follow all instructions provided by guides and adhere to safety protocols at all times. Failure to comply with guide instructions may result in immediate removal from the expedition without refund.

All participants are required to sign a liability waiver before participating in any expedition. PeakTrail Adventures, its employees, and contractors are not liable for any injury, loss, damage, or expense arising from participation in our activities, except where liability cannot be excluded by law.

7. Code of Conduct

All participants are expected to:

  • Treat guides, staff, and fellow participants with respect and courtesy
  • Follow Leave No Trace principles and minimize environmental impact
  • Refrain from behavior that endangers themselves or others
  • Abstain from alcohol and illegal substances during expeditions
  • Respect wildlife and maintain appropriate distances from animals
  • Stay with the group and follow designated trails unless otherwise instructed

We reserve the right to remove any participant whose behavior is deemed inappropriate, dangerous, or disruptive, without refund.

8. Equipment and Property

PeakTrail Adventures provides specified safety equipment as outlined in your expedition package. Participants are responsible for bringing appropriate personal clothing and gear as detailed in the pre-expedition information provided.

Participants are responsible for any loss or damage to equipment provided by PeakTrail Adventures due to negligence or misuse. Repair or replacement costs will be charged accordingly.

9. Photography and Media

During expeditions, PeakTrail Adventures may take photographs and videos for promotional purposes. By participating in our services, you grant us permission to use your image in marketing materials, website content, and social media, unless you explicitly opt out in writing.

We respect your privacy and will not share personal information associated with photographs without explicit consent.

10. Insurance

PeakTrail Adventures strongly recommends that all participants obtain comprehensive travel and activity insurance covering medical expenses, evacuation, trip cancellation, and personal liability.

While PeakTrail Adventures maintains public liability insurance, participants are responsible for their own medical expenses and travel insurance. We are not responsible for costs associated with medical treatment, evacuation, or trip interruption.

11. Intellectual Property

All content on the PeakTrail Adventures website, including text, graphics, logos, images, and software, is the property of PeakTrail Adventures and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission from PeakTrail Adventures.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

13. Force Majeure

PeakTrail Adventures is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, extreme weather events, government restrictions, pandemics, war, terrorism, or other force majeure events.

In such circumstances, we will work with affected participants to reschedule expeditions or provide alternative solutions where possible.

14. Changes to Terms

PeakTrail Adventures reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date.

Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of South Australia.
